Update!

Went through the surrender process at the local Nissan dealership with the Morley rep last week. Took about 20 minutes. Brought the vehicle, title, 2 key fobs and charging cable.

Received check for $34,768.62 for our 2016 Leaf with 40K miles. Basically drove it for free for over 6 years!

Check has cleared and we have since purchased a 2023 Nissan Ariya Platinum Plus Eforce. Top of the line for 62K.

Got $1000 off for Nissan Loyalty. Got another $1100 off for special discount code received in buyback. Got another $3750 off for special rebate for financing through Nissan financial.

Got first billing statement from Nissan financial and paid off new Ariya using buyback funds plus cash.

Considered using buyback funds to get a cheaper EV for free(Tesla M3, Y etc...) But like the Ariya much better, plus did not qualify for tax credit due to income.

Couldn't be happier. The Ariya is an amazing EV.

Whoa... I thought I did well with $27K. Well played!

How picky was Morley? I paid $600 to fix some bad scratches and dings. Car is looking good but has some minor issues. It's been about a month since I accepted Nissan's offer. Would like to know how much I have in the bank. Hope to turn it in soon.

Didn't seem picky at all. Ours was in nice shape though. Had a few touched up rear bumper scratches and a reglued drivers door handle that worked okay. Otherwise no other major wear. Was a little worried a few days before drop off because the electronics were acting a little weird but realized the 12v battery was probably low. Put it on a battery tender for a day and all problems went away. Transfer was quick and easy.

I got my buyback calculations. Since I bought it used from carmax for $14,000 that was the starting price.

However, I am not sure about the Mileage Usage deduction calculation.

"NNA is entitled to deduct a use charge. The amount that is charged for use is determined by multiplying the actual price of the new vehicle by a fraction having as its denominator 120,000 and as its numerator the number of miles traveled by the vehicle before it was FIRST BROUGHT in for correction of the XXX" (my agreement just says xxx).

Based on the Song Beverly Consumer Warranty Act and the documents we have received, we calculate the repurchase calculation as follows:

Downpayment: $15,511.94
Less Usage: (36090 miles [this was the mileage when I bought it] / 12,000 x $13,998 (this was the sticker price prior to taxes) = $4,000
Total Refund: $11,512.

So two questions:

1. What have people's usage deductions been like? it seems they used the mileage when I bought it.
2. I found a 2016 Leaf S with 11 bars near me for $12,600 (1 owner, 30,000 miles) I kind of think maybe selling buy back and picking up an 11 bar leaf. I don't think it will hit its own 8 bars before 12/2024 but it couldn't hurt. My current leaf is dropping 1% SOH ever few months so it is really scary to see how fast it is going.

The arbitrator reiterated that there are no batteries coming. My dealer has said no batteries have showed up at his shop for the 10 people in the queue in 2 months. :(

My usage deduction fit neatly into my states lemon law in MN which benefited me greatly as an original owner. You can search for my posts/story.

FWIW... I'm starting to see some '17 Bolts coming down in price and pushing $16-17K (check Autotrader). If you qualify for the $4K used EV fed tax credit, you'll get into a much more reliable battery situation for the $12.6K that Nissan would give you.

UnFortunately (our magi is above $150,000 so don’t qualify for the used ev credit.

Would just swap over to a new to me 12/11 bar leaf and keep the slow death going / boost a few more years into my leaf driving (with the new to me second car)
The new leaf likely would not get the warranty timeline but that’s fine to slowly die over the next 10 years of commuter use

Moving my saga over here from the 30Kwh lost bars thread since I just signed the buyback papers this morning. I have been waiting since December for a battery and I don't think I will live long enough to see a replacement. I spoke with the dealer yesterday and they believe that the batteries are going to be even harder to get going forward then they currently are. Also, they haven't had any loaner vehicles since the supply chain issues created by Covid and since I am now down to seven bars I don't know how much longer I can use the car. He suggested I contact Nissan CA about a rental reimbursement. I didn't mention that I was looking into the buyback process.

Since I bought my Leaf used, there is little to no coverage in Texas' lemon laws. I was not impressed with the first offer. The original offer was only enough to purchase a used 24Kwh vehicle that would not fit our commute. I sent a reply to the arbitration specialist comparing this with what I would have had if they had given me a new battery. I went to bed believing there was no way I would ever buy another Nissan vehicle. I was pleasantly surprised this morning with the counteroffer. I don't want to jinx anything so will wait to share details once the process is complete.

That doesn't sound right. Shouldn't nissan factor in your buying price minus the miles you drove?

Every state has different consumer protection/lemon laws.

"Song Beverly" I'm pretty sure refers to California. Mitrals, you aren't in CA.

When I went thru Bolt buyback, there was definitely variance in how strong/in favor of the consumer such laws were and the details of what was allowed to be deducted. They ranged (for Bolt buyback due to battery recall) from crap to a few states allowing for a FULL refund (automaker can't deduct for usage). CA wasn't in the full refund camp. It was out of 120K miles and Song Beverly and/or California lemon law was mentioned in one of my letters from GM.

Then there are other details about whether the car was financed, how much was down, interest paid, etc. I didn't follow any of that since I paid for my former Bolt in full. I never had any loan or lease on it.

I even started a poll/thread about this at https://www.chevybolt.org/threads/for-those-who-attempted-or-completed-buyback-due-to-the-bolt-battery-fire-recall-did-gm-deduct-anything-for-usage.43782/.

Magi can be lowered by 401k contributions but there is not another way to lower magi and it is too far just to get a $4000 used ev tax credit

That is very easy to fix
Not really, esp. if one's income is well over the income caps (https://www.irs.gov/credits-deductions/used-clean-vehicle-credit) even after maxing out one's 401K. I'd have to quit my job pretty early in a tax year and stop earning other income (e.g. dividend and interest).

If I got fired or laid off from my job, my company normally pays several months severance pay... So, I'd have to be fired very early in the year (like January 1st) and stop my other forms of income.

Reading the Canadian Nissan Leaf Facebook group, two 40kWh packs were installed due to warranty last month. I emailed Nissan Canada about this, since I had been waiting before them and they told me that those packs had a different part number (I have a 2017 Leaf, the replacement was done on a 2018). Corporate told me that my part number would be 295B04NP7B.

For those that had a replacement pack installed in their car, what was the part number of the replacement battery pack you had?

How long does it usually take to get answers from Nissan? I have a 2017 Leaf, battery dropped below 8 bars in April. The local dealer verified in May or early June and confirmed it would be a warranty replacement, and they would call us as soon as they had a timeline for replacing.

I called the dealership in late July, and finally when they had no answers called Nissan USA about a month ago. Within 10 days I got an email "... Nissan North America would like to extend the offer to repurchase your vehicle..." and I called several times, left a few messages (as I wanted replacement not repurchase). I read the forums, figured I'd wait forever if I insisted on replacement and sent in all required repurchase documentation August 23. Followed up with calls and emails, but have not heard back.

I need this car to get to work, I drive an average of 80 miles a day and I live in an area without enough public charging, and the Leaf charges at 3 kWh not like most at 6, so about 15 miles per hour. I waste a lot of time with this car...

Bummer. You mean 3 kW? Charging rate is measured in kW, not kWh.

Do you have an S trim? Per https://usa.nissannews.com/en-US/releases/release-f6fcf40f78a54118a8a01526272638f0-us-2017-nissan-leaf-press-kit, like all '13 to '16 Leafs, the S trim only comes with 3.6 kW on-board charger and going to 6.6 kW OBC costs extra (e.g. via charge package).

The arbitration buy-back process after submitting the forms can be 1-3 weeks. ping your emailed arbitration person for an update. however, sometimes they take time to get back to you. I responded with a question to my offer and it took 1.5 weeks to hear back.

he also reiterated that the offer can be revisited at a later date if you decide. "Just know that the battery would still not be available".

My dealer said no batteries showed up in August ... hopefully they somehow show up! I just will keep waiting and keeping in contact.

Also not clear is the usage deduction. Especially if it is a used car purchase vs new car. Mileage at purchase vs mileage at 8 bar drop ...

I called Nissan in April when my battery qualified for warranty. Brought the car to the dealer. They said it qualified. Not much happened until I got advice here to do the bbautoline. Did that early July. Got a call from Nissan the next day. They sent me some docs with what they were willing to pay. I had to send a lot of docs to them.

I have been very frustrated that not much has happened since July. I email every week. Got a call today from new Nissan AS. Last guy is no longer with the company. This girl seems to give a crap. Hope this is over soon.

We bought a 2017 Nissan LEAF SV in 2020 (COVID), 49K miles, for $6,500. We've been thrilled with the car, our DD. We're in Hawaii with solar and PW2 house batteries and the only problem with the leaf is we export too much power to the grid. We keep the battery between 40% an 80%, except once a month 100% charges. Saturday was 100% charge and the gauge showed 62 miles. Drove to Home Depot. Came out and car wouldn't start. Had it towed to Nissan dealer a couple blocks away.

Today the dealer called me. They're ordering a new battery, which she said is free. Car now has 67K miles. She offered a loner but we declined. The same dealer gave us a loner when the Leaf was hit and had minor body damage. We hated the loner so we'll just drive one of our ICE Jeeps. Can I use loaner decline as a bargaining chip? I'm sure it's going to be expensive to ship a Li battery to HI.

We're excited to get a new battery or maybe $17,500.

Got a call from Nissan. They said I should be happy with the new offer, they it reduced by $10,000 and upped it by seven. The reduction was what they claim to be a rebate offered by my power company. So the guy who is no longer with Nissan made a mistake and now the offer is $3000 less. Even though I had to wait months to get to this point. Well I’m not happy.

I’m really not sure what to do. It’s not like their offer isn’t close to fair, or I should say it would’ve been fair a month or two ago. But after waiting all this time… they made me an offer that was apparently incorrect. It’s only $3000 difference. But I was hoping they would throw me a few bucks for the aggravation for dealing with somebody who was completely incompetent and is now fired.

I’ll except their best offer, but how do you tell a customer that our last offer was a mistake and you had to wait longer and we’re not going to honor it . We will give you less and you should be happy. I really like my Leaf. I wish I got a new battery. I wish they had their crap together. I wish they didn’t piss me off because I feel like they need to make this right.
